Terms and Conditions

Dear Guests, I’m a small private landlord, not a hotel chain. Basically, common sense applies between you and me 🙂 and—if it were up to me—I’d actually like to keep it that way. Unfortunately, today’s world isn’t quite that simple (even though I’d love it to be, especially with such a laid-back place), so here are a few rules. In particular, my/your neighbors would like the vacation community to be used quietly, in everyone’s best interest.

This agreement is entered into between the tenant and the landlord. Information provided by telephone, side agreements, and other representations are only part of this agreement if they have been confirmed in writing by the landlord.

The rental property includes a lakeside cabin with a terrace, along with building services, furniture, furnishings, and other fixtures and fittings. The boat is not included in the rental agreement. While you may use the boat if it is in working order, you have no legal right to a fully functional boat for the duration of your vacation if, for example, it is defective or if, for instance, water levels prevent navigation on the lake. Each cabin has a boat, but the idea is to share them. If your boat isn’t working, the friendly guests at the other two cabins should help out, PROVIDED they aren’t using it themselves at the time. If that isn’t possible, you can rent a boat for one hour per day at my expense from the boat rental (a few hundred meters away).

Conclusion of the Agreement 1. The tenant will receive a booking confirmation (via email) from the landlord upon receipt of the tenant’s written booking (via the internet or by phone). 2. Upon receipt of the booking confirmation, the tenant’s acceptance of this rental agreement becomes legally binding. At the same time, the tenant shall pay the rental price or a deposit (depending on the agreement, deadline prior to the start of the vacation, etc.) via bank transfer to the landlord’s bank account or using any other payment methods offered by the landlord. Through all these steps, the tenant has bindingly agreed to enter into a rental and payment agreement with the landlord for vacation purposes; thus, the tenant has also accepted the online description of the landlord’s vacation offer, the landlord’s prices valid at the time of booking, as well as the following payment and reservation terms and the landlord’s other terms and conditions. 3. Upon booking, the tenant must submit a photo of all guests’ passports via email, as this is required for the guest registration form.

Rental Rates Rental rates, peak seasons, and rental periods are listed online and are binding; the prices quoted apply to a single rental period. A security deposit must be paid separately. Security Deposit The tenant is fully liable for any damage to the house, terrace, or boat that occurs during the rental period and is the tenant’s fault, even if no security deposit was required. The same applies to missing inventory (as compared to the inventory list). Don’t worry—nothing has ever been missing; it sounds stricter than it is.

The rental price includes the following services provided by the landlord: 1. Provision of the rental property for use during the rental period. 2. Provision of bed linens, hand towels, and bath towels for use within the vacation home during the rental period. 3. Coverage of utility costs (water, electricity, heating, cooling, gas for the grill) by the landlord. 4. Boat: If the boat is unavailable due to a defect, etc., the landlord’s liability for damages is limited as follows: The guest may rent a boat at the harbor at the landlord’s expense, but for a maximum total duration equivalent to a 2-hour boat trip per day for each day of the stay (this may also be redeemed on a daily basis, e.g., a full day corresponds to 8 or 10 hours, depending on the boat rental company’s terms).

Vacation Home Availability

The vacation home sleeps a maximum of 5 people. In individual cases, we can discuss whether it might be possible to accommodate more guests. In the event of unauthorized overcrowding, the landlord may terminate the agreement immediately and without compensation and retain the rent paid. All cabins are LOCATED IN THE WATER; NO LIABILITY is assumed for non-swimmers and children. The two sleeping areas under the roof are accessible only via a steep ladder (at Cabin 57a, the ladder is still relatively comfortable, but nevertheless…) and are therefore not suitable for people with limited mobility or small children who are not sure-footed. No liability on the part of the landlord.

Pets are allowed only with the landlord’s prior approval and may be subject to additional fees. Extra cleaning costs may be charged if, for example, dogs or cats have been on the bed or sofa. A big request to pet lovers: please understand that not everyone loves your dog as much as you do. Under NO circumstances are pets allowed on the sofa, in the bed, etc. Out of respect for future guests and my staff. THANK YOU.

Access to the vacation home is via a wooden walkway that includes approximately 10 steps. There is usually NO staff on site, so please make your own arrangements if you need someone to help carry your luggage.

Duty of supervision

The tenant is aware that the kitchen, living room, one bedroom, and bathroom with toilet are located on the ground floor of the vacation home. The shower at No. 19a (Robinson Hut) is located outdoors. Two additional beds (a double bed without legs or a headboard) are located in the attic, accessible only via a ladder. The tenant must specifically warn children, people with disabilities, and their accompanying persons of the associated risks. The landlord disclaims all liability.

Cancellation Policy

My vacation rentals are typical vacation properties, and most travelers plan their vacations well in advance. The shorter the notice of your cancellation, the harder it is for me to find a suitable replacement guest. With only three cabins, every single cancellation naturally hits me much harder than it would a hotel with 20 or more rooms. I therefore ask for your understanding regarding the following cancellation policy:

The tenant is granted a contractual right of withdrawal until the start of the rental period. Withdrawal from the rental agreement must be notified to the landlord in writing (email is sufficient; the date of receipt by the landlord is decisive). The landlord may demand compensation for any arrangements made and expenses incurred. Thus, in the event of withdrawal from the rental agreement, a cancellation fee of 15% is due if notice is given less than 60 days before the start of the rental period, 33% up to the 45th day before the start of the rental period, 66% up to the 30th day before the start of the rental period, and 80% up to the 14th day before the start of the rental period. For cancellations made later than these deadlines, the full amount is due. However, there is aFAIRNESS clause: sinceI do not wish to profit from your misfortune—after all, no one likes to cancel their vacation—no cancellation fee will be charged if the accommodation can still be rented out (minus a 10% processing fee and any discounts (e.g., last-minute) that had to be granted).

Coronavirus/COVID-19: NO CANCELLATION FEE if, due to legal restrictions, you are unable to take a vacation in Rust on the dates you booked (ban on accommodation due to COVID). If there is NO ban on accommodation but YOU personally fall ill, a cancellation fee will unfortunately apply. Therefore: to ensure you are financially protected even if you fall ill, I recommend purchasing travel insurance, e.g., https://www.europaeische.at/

House Rules

  • Please respect the fact that this is a community ofprivate weekend homesinhabited by people who value their peace and quiet. The stilt house isnot a party venue. Pleasealways keep in mind, when it comes to your behavior and noise levels, that this is a private and quiet community. You, too, will benefit from this mutual consideration.
  • The tenant shall keep the rental property in good condition and, in particular, shall comply with the City of Rust’s guidelines on waste separation. Smoking is prohibited inside the building.
  • In general, disturbances of the peace—such asparties, celebrations, or loud noise—are strictly prohibited. Please be especially considerate of your neighbors (keep it quiet!) between 10:00 p.m. and 7:00 a.m.
  • Defects and Damage to the Rental Property Aninventory listis provided in the vacation home. This list is considered complete and accurate unless the renter notifies the landlord to the contrary within the first day of arrival.
  • The tenant agrees to immediately report any defects, damage, or problems with the utility supply to the landlord by telephone. The same applies to the loss of keys; in such cases, the landlord is entitled to have a new lock system installed at the tenant’s expense without further consultation with the tenant.
  • The tenant is liable for any damage to the rental property caused by the tenant or third parties under the tenant’s responsibility (e.g., accompanying persons, guests, and visitors), as well as for any lost furnishings or inventory, and for all other liability claims.
  • Liability for Damage Caused by the Tenant and Third Parties: The tenant, their guests and visitors, and any items they bring with them are not insured by the landlord during the rental period, and the landlord is not liable for such items, even if the cause is related to the rental property.
  • Pets – Unfortunately, this is a very sensitive topic. In short: small, short-haired dogs are allowed. The larger and longer-haired the dog, the more likely I am to run into trouble with my cleaning staff, because dog hair is really hard to remove, and a wet dog on a sofa can cause major problems. I’m also not sure how much extra to charge for dogs, since not every dog requires extra cleaning. Currently, small pets are free, and large ones aren’t allowed. Any special cleaning required will be billed separately. By default, there are no additional costs.
  • Check-in and Check-out: The key to the vacation home will be provided to the tenant at the start of the rental period via a key box and code. During the stay, the tenant is responsible for keeping the key in a secure place. The guest agrees to return the key to the key box when checking out of the vacation home. The tenant will take possession of the rental property directly on-site at the agreed start of the rental period. The rental property can be occupied on the day the rental begins at approximately 2:00–3:00 PM. The rental property and, if applicable, the key must be returned on the agreed departure day by approximately 10:30 AM.
  • Disturbances caused by the tenant: The landlord may terminate the lease agreement during the tenant’s stay without refunding the rent if the tenant, their guests, or visitors persistently violate the terms of the agreement (such as disturbing the peace at the vacation complex or using the property in a manner contrary to the contract) despite a warning (a verbal warning is sufficient).
  • Landlord’s Disclaimer: The landlord assumes no liability whatsoever, particularly in the event of a failure to perform or impossibility of performance. Severability Clause: Should any part of this agreement be or become invalid, this shall not affect the validity of the remaining parts. The invalid parts shall be replaced by provisions that most closely reflect the intent of the invalid part.
